Terms of Use

These Terms of Use govern your use of PlanetHello, a voice-based app that connects people for anonymous audio calls based on shared interests and compatible matching preferences.

Acceptance of Terms

By using PlanetHello, you agree to these Terms of Use and our Privacy Policy. If you do not agree with these Terms, do not use the app.

By installing PlanetHello through the Apple App Store or Google Play, you also agree to the applicable app store terms and policies.

Eligibility

PlanetHello is for adults only. You must be 18 years of age or older to use the platform.

If you believe someone on PlanetHello is under 18, report the account immediately after the call.

Some app store terms may reference a lower minimum age or parental consent. PlanetHello's service rule is adults only. Where rules differ, the stricter age requirement applies.

Account creation requires email and phone number verification. Users who do not complete verification cannot initiate calls. We may additionally require age verification at signup or following user reports. Refusing or failing verification results in suspension or termination.

The PlanetHello Service

PlanetHello connects users for one-time, voice-only audio calls. PlanetHello does not provide video calls, posts, feeds, followers, direct messages, file sharing, or call history.

Calls are encrypted in transit using AES-256 and TLS 1.2/1.3. Calls are facilitated in real time and are not end-to-end encrypted. PlanetHello does not record, store, or access call content.

Matching

PlanetHello matches users based on filters you select, including: call category, age range, gender, spoken language(s), country, and content preference. Matching is one-to-one within the category and filters you choose.

You may also exclude your phone contacts from matching. If you enable contact exclusion, PlanetHello compares your contacts' phone numbers against potential matches at the time of matching. No contact information is stored on PlanetHello's servers. Contact exclusion is optional and can be disabled at any time through your device settings.

PlanetHello uses your IP address to determine your country. VPN use is not permitted and may result in being unable to use the service or account suspension.

What your call partner sees

Before and during a call, your match will see the following information about you:

  • The category you are calling in
  • The country you are calling from (based on your IP address)
  • Your age range (for example, 20s, 30s, 40s)
  • Your gender (male, female, nonbinary, or other)
  • Your spoken language(s)
  • Whether you have enabled a mature-language preference for this call

No other personal information is disclosed to your call partner. Your name, phone number, email address, and exact age are never shared.

Safety Rules

To help keep PlanetHello safe and appropriate, you agree to follow these rules:

  • Do not share your full name, address, phone number, email, social media handles, or other identifying information during a call.
  • Do not share your physical location or ask another user to share theirs.
  • Do not solicit money, gifts, donations, financial information, or payment of any kind.
  • Do not record, transcribe, screenshot, or capture any part of any call.
  • Treat other users with courtesy and respect.
  • Do not harass, threaten, demean, abuse, or discriminate against another user based on race, ethnicity, gender, sexual orientation, religion, disability, or any other personal characteristic.
  • Do not use PlanetHello for illegal activities, illegal content, or criminal behavior.
  • Do not impersonate another user, public figure, or any other person.
  • Do not use PlanetHello to advertise, promote, market, or sell products or services.
  • Do not use AI voice generation, voice cloning, bots, or automation to simulate or replace your presence.
  • Do not use a VPN or attempt to misrepresent your country or location.
  • Do not attempt to identify, locate, or contact your call partner outside of PlanetHello.
  • Do not harm the platform or other users, including by hacking, spreading malware, attempting to disrupt the service, or attempting to access the app's source code, systems, or non-public areas.

Call Categories and Content Standards

Standard categories

Standard categories are available to all adult users. Conversations in standard categories must comply with these Terms and the Community Guidelines.

Mature language

Users may enable a mature-language preference to be matched with others who permit mature language. Sexually explicit content and solicitation are prohibited (see Community Guidelines).

Prohibited Conduct

You agree not to use PlanetHello for any unlawful, harmful, abusive, fraudulent, or prohibited purpose.

Prohibited conduct includes:

  • Sexual content involving anyone under 18, in any form, real or simulated
  • Solicitation of commercial sex and any form of sex trafficking — prohibited and will be reported to law enforcement
  • Non-consensual sexual conduct or coercing another user into sexual conversation
  • Sexually explicit content or sexual solicitation of any kind
  • Harassing, threatening, abusing, or defaming other users
  • Sharing obscene, offensive, abusive, hateful, violent, or unlawful content
  • Threats of violence, doxing, or incitement of violence
  • Hate speech targeting race, religion, gender identity, sexual orientation, disability, or national origin
  • Violating intellectual property, privacy, publicity, or other rights
  • Attempting to hack, reverse engineer, disrupt, or gain unauthorized access to PlanetHello
  • Using PlanetHello for deceptive or fraudulent behavior, including impersonation
  • Promoting illegal substances, weapons, or controlled goods
  • Promoting tobacco products, ammunition, or firearms
  • Promoting gambling, including online casinos, sportsbooks, bingo, poker, or related activity
  • Using PlanetHello for commercial solicitation, advertising, spam, or scams
  • Using AI-generated voices, bots, or voice cloning to misrepresent your identity
  • Circumventing enforcement, including creating new accounts after a ban

Reporting and Enforcement

If a call felt unsafe, abusive, threatening, harassing, sexually inappropriate, or clearly wrong, report it from the post-call rating screen immediately after the call ends.

PlanetHello may review reports and take action when we believe these Terms, our Community Guidelines, our Safety Rules, or other policies have been violated.

Enforcement may include:

  • Warnings
  • Temporary suspensions
  • Phone verification requirements
  • Account restrictions
  • Permanent bans

Serious violations can result in a permanent ban connected to account identifiers such as email and phone number. We also review attempts to return to the platform after a ban.

We do not share the outcome of a report, but every report is reviewed.

App Store Terms

If you download PlanetHello through the Apple App Store or Google Play, your use of the app is also subject to the applicable app store's terms, policies, and license rules.

These Terms are between you and [Legal Entity Name], a [State] limited liability company, not Apple Inc. or Google LLC. PlanetHello is responsible for the PlanetHello app and its content, except where an app store's terms provide otherwise.

Limited License

PlanetHello grants you a limited, non-exclusive, non-transferable, revocable license to use the PlanetHello app for personal, non-commercial purposes.

If you use PlanetHello on an Apple device, you may use the app only on Apple-branded products that you own or control and as permitted by the Apple App Store Terms of Service.

If you use PlanetHello through Google Play, your use of the app is also subject to the Google Play Terms of Service and any applicable Google Play policies.

Privacy

PlanetHello may collect and use information about your usage of the PlanetHello app, including certain types of information from and about your device.

Maintenance and Support

PlanetHello may provide maintenance or support for the app.

To the extent maintenance or support is required by applicable law, PlanetHello, not Apple or Google, is responsible for providing it.

Apple-Specific Terms

For users who download PlanetHello through the Apple App Store, you acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

PlanetHello, not Apple, is responsible for providing maintenance and support for the app to the extent required by applicable law.

PlanetHello, not Apple, is responsible for addressing claims relating to the PlanetHello app or your use of it, including:

  • Product liability claims
  • Claims that the app fails to conform to legal or regulatory requirements
  • Claims arising under consumer protection or similar laws

To the extent any warranty exists under law that cannot be disclaimed, PlanetHello, not Apple, is solely responsible for that warranty.

To the extent PlanetHello is required to provide indemnification by applicable law, PlanetHello, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any claim that the PlanetHello app or your use of it infringes a third-party intellectual property right.

Google Play-Specific Terms

For users who download PlanetHello through Google Play, your use of the app may also be governed by the Google Play Terms of Service and applicable Google Play policies.

Google is not responsible for PlanetHello's content, functionality, maintenance, support, or handling of user claims, except where required by applicable law or Google Play's terms.

PlanetHello is responsible for addressing questions, complaints, or claims about the app.

Warranty Disclaimer

PlanetHello is provided "as is" and "as available" without warranties or representations, express or implied.

We do not warrant that the app will be uninterrupted, secure, error-free, or available at all times. We do not make representations regarding the use, results, accuracy, reliability, safety, or availability of the app.

PlanetHello disclaims all warranties about the PlanetHello app to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, PlanetHello is solely responsible for that warranty.

Limitation of Liability

To the fullest extent permitted by law, PlanetHello shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with your use of, or inability to use, the app.

PlanetHello's total liability to you for all claims shall not exceed the greater of $100 or amounts you paid to PlanetHello in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold PlanetHello harmless from any claim, demand, loss, liability, damages, costs, or expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your use of the app
  • Your violation of these Terms
  • Your violation of any rights of another user or third party
  • Your violation of applicable law

Product Claims

PlanetHello is responsible for addressing claims relating to the PlanetHello app or your use of it, including:

  • Product liability claims
  • Claims that the app fails to conform to legal or regulatory requirements
  • Claims arising under consumer protection or similar laws

Third-Party Intellectual Property Claims

To the extent PlanetHello is required to provide indemnification by applicable law, PlanetHello is solely responsible for the investigation, defense, settlement, and discharge of any claim that the PlanetHello app or your use of it infringes a third-party intellectual property right.

Dispute Resolution — Binding Arbitration

Please read this section carefully. It affects your legal rights.

Agreement to arbitrate

You and PlanetHello agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, the Community Guidelines, or your use of PlanetHello will be resolved by binding individual arbitration rather than in court, except as stated below.

Informal resolution first

Before initiating arbitration, contact support@planethello.com to describe your dispute. If not resolved within 30 days of written notice, either party may initiate arbitration.

Arbitration rules

Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (adr.org), in English. Proceedings will be held in New York, New York, or by telephone or video at your request.

Costs

For claims under $10,000, PlanetHello will pay all AAA filing fees unless the arbitrator finds your claim frivolous.

Class action waiver

YOU AND PLANETHELLO AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, REPRESENTATIVE, OR MASS ACTION. IF THIS WAIVER IS UNENFORCEABLE, THE ENTIRE ARBITRATION AGREEMENT IS NULL AND VOID.

Exceptions

The following are not subject to arbitration: (a) small claims court matters; (b) emergency injunctive relief; (c) intellectual property claims.

Opt-out

You may opt out of this arbitration agreement by emailing support@planethello.com with the subject line "Arbitration Opt-Out" within 30 days of first using PlanetHello, including your name and a statement that you wish to opt out.

Changes to These Terms

We may update these Terms as PlanetHello changes. For material changes, we will provide at least 30 days' advance notice by email or in-app notification where reasonably practicable.

Your continued use of PlanetHello after changes become effective means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

For claims not subject to arbitration, legal actions arising out of or relating to these Terms or your use of PlanetHello will be brought in courts located in New York, New York, unless applicable law requires otherwise.
